About This Course
By the end of the course, students should be able to:
(a) Understand how to write an enforceable arbitration award;
(b) Understand the sources of the law which govern decisions and the requirements of an enforceable award;
(c) Understand the requirements of the New York Convention on the enforceability of awards (Article V);
(d) Understand why the identification, marshalling and determination of ‘issues’ is of critical importance in drafting an enforceable award;
(e) Understand the internal processes the arbitrator goes through in his / her approach to the analysis of the issues in dispute;
(f) Understand how the evidence is used to determine each issue in dispute;
(g) Understand how to apply the law in the process of reasoning and the requirement for reasons in an award;
(h) Understand the essential contents of an award;
(i) Understand the detailed form that an arbitration award must take;
(j) Understand what is required for an effective publication of an award;
(k) Understand how to deal with correction of errors;
(l) Understand how to deal with ambiguities by way of an additional award;
(m) Provision for payment of fees of the arbitrator;
(n) Use of concise, relevant and clear language;
(o) Understand applicable legal conventions.
