The Art and Science of Negotiation
About This Course
Negotiation is not improvisation. It is structured preparation, clear positioning, controlled communication, and disciplined follow-through.
This course develops the ability to conduct negotiations with other parties to achieve optimal outcomes for the organisation. Trainees learn to define negotiation objectives aligned to organisational strategy, design complete structured negotiation plans, analyse the context and constraints that shape each negotiation, draw on relevant precedents, prepare BATNA and alternative scenarios for both parties, and execute the full negotiation process from opening through bargaining to agreement, including an extended full-cycle simulation of a multi-issue commercial negotiation.
Because complex commercial negotiations involve disagreement by design, trainees practise resolving conflicts by building consensus while maintaining organisational interests: recognising the patterns behind positional deadlock, emotional escalation, precedent disputes, and regulatory disagreement, and applying structured communication and conflict resolution techniques to move each toward agreement. The regulatory dimension runs alongside: contract law principles, data protection obligations, and compliance constraints are built into planning and conduct rather than discovered after signature.
The course closes the loop with the discipline most negotiators skip: finalising agreements, executing follow-up actions in alignment with organisational procedures, monitoring and evaluating outcomes against defined objectives, and converting each negotiation into precedent intelligence for the next. Trainees leave able to enter complex commercial negotiations with a complete plan, conduct them with control, and close them with agreements that hold.
